Nope, this isn't crimincal law, this is civil law. All they have to do
is show a "prepderance of evidence." That is, if you could have looked
at the code, and then you produced something very much like the code,
then the odds are that you did look at the code.
IANAL, but I have bothered to read some text books written for engineers
on the subject of intellectual property and contract law. If you do not
understand the basic rules of a game you can not win. When you don't
bother to learn the basic rules that your entire society operates
under... You are screwed!
